7. Warranties and Disclaimers
Our services are provided "as is" and "as available."
We make no warranties, express or implied, regarding the performance, reliability, or fitness for a particular purpose of any deliverables, except as explicitly stated in a project agreement.
8. Limitation of Liability
To the fullest extent permitted by law, Above Capital shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or business opportunities, arising from the use or inability to use our services.
9. Termination
Either party may terminate an engagement with written notice if the other party breaches these Terms or the specific project agreement. Upon termination, all outstanding fees for completed work remain payable.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
11. Changes to Terms
We may update these Terms from time to time. The revised version will be posted on our website with an updated effective date. Continued use of our services after such updates constitutes acceptance of the new Terms.
